This Agreement governs your use of the mobile application Catoptica (“the Product”), supplied by Catoptica Pty Ltd (“Licensor”, “we”, “us”).
By installing or using the Product, you (“Licensee”, “you”) agree to these Terms.
If you do not agree, you must not use the Product.

Important Notice (Apple App Store Users): This app is licensed to you under Apple’s Standard End User License Agreement (EULA).

These Terms and Conditions are supplemental and apply in addition to Apple’s Standard EULA. In the event of any conflict, Apple’s Standard EULA will govern. 

1. DEFINITIONS

Product
The Catoptica Multispecies Vibe Translator mobile application described in Schedule 1.

The Apple App Store and Google Play Store.

2. ACCEPTANCE OF TERMS

By using the Product, you acknowledge and agree that:

• The Product is a spiritual technology that blurs the boundaries of art and science, presenting a living phenomenon of magnetism, resonance, and symbolic content.

• All outputs are subjective, poetic, symbolic, and contemplative in nature.

• Outputs may evoke emotional or psychological responses, including discomfort or intensity.

• You use the Product at your own risk, and should cease using it if distressed or overwhelmed.

• You are granted a revocable, non-transferable, non-exclusive, limited licence to use the Product, subject to these Terms.

3. LICENSE GRANT

(a) You are granted a licence to install and use the Product on devices associated with your Apple ID or Google Account, subject to App Store terms.

(b) Distribution, installation, billing, and subscription management are governed by the rules of the App Store or Google Play Store. Where these rules conflict with this Agreement, App Store/Google Play terms prevail.

(c) The Product may not be exported, copied, or redistributed except as permitted by App Store/Google Play rules and applicable law.

4. LIMITATIONS

You must not:

• reverse engineer, decompile, or modify the Product

• attempt to derive the source code

• copy or reproduce the Product outside standard device backup processes

• circumvent subscription, access, or parental lock controls

• use the Product for unlawful, harmful, or abusive purposes

• commercialise the Product without written permission from Catoptica

The Lexicon of the Soul, Catoptica algorithm, text corpus, audio content, and artistic framework remain strictly protected works.

5. OWNERSHIP AND INTELLECTUAL PROPERTY

(a) The Licensor retains full ownership of the Product and all associated intellectual property.

(b) The Catoptica Algorithm and Lexicon of the Soul are sacred artistic works protected under international copyright laws, intended for symbolic and contemplative use.

(c) The author, Helah K Milroy, retains full moral rights, including attribution and integrity of the work. No derivative works may be made without written consent.

(d) No cultural, ceremonial, spiritual, or cosmological rights associated with the app’s use are transferred to the Licensee.

6. SUBSCRIPTIONS, ADS & FEATURES

(a) Subscriptions

Ad-free access and offline use of Catoptica require an auto-renewable subscription. Payment will be charged to your Apple ID or Google account at the time of purchase confirmation. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription at any time through your App Store or Google Play account settings. Subscription pricing and duration are disclosed at the time of purchase. 

(b) Anonymous Subscription System (RevenueCat)

The Product uses RevenueCat to assign a non-identifying anonymous appUserID to validate subscription status. No names, emails, or personal profiles are collected.

(c) Advertising (AdMob)

The Product displays ads using Google AdMob, which may collect and track limited device data (e.g., device identifiers, coarse location, usage data) for personalised or non-personalised ads depending on your consent preferences.

(d) Parental Lock PIN

An optional parental lock may be enabled to restrict access to the Uncensored Lexicon.
The PIN:

• is stored locally on your device

• is never transmitted

• cannot be recovered or reset by us

7. WARRANTIES, EXCLUSIONS, AND DISCLAIMERS

The Product is provided “as is” as a spiritual technology that blurs the boundaries of art and science, presenting a living phenomenon of magnetism, resonance, and symbolic content.

The Product does not:

• provide objectively verifiable readings

• diagnose, treat, or predict any medical or psychological condition

• offer scientific, factual, or evidence-based insights

• provide instructions or professional guidance

• guarantee output accuracy, stability, or device compatibility

• operate consistently across all environments or electromagnetic conditions

You accept full responsibility for your engagement with the Product and your interpretation of its outputs.

Where consumer guarantees under the Australian Consumer Law apply, our liability is limited to resupply, repair, or replacement.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees that cannot be excluded under the Australian Consumer Law. 

8. SYMBOLIC AND EXPERIENTIAL NATURE OF OUTPUTS

Users may find the symbolic content insightful or helpful when reflecting on experiences, including those involving animals, but the Product is not a substitute for veterinary, medical, psychological, or professional advice. Users should not rely on Catoptica for decisions concerning health, safety, or well-being.

Catoptica responds to shifts in the magnetic field through a process of resonance, selecting symbolic outputs that may be experienced as meaningfully aligned with lived experience. These moments of alignment are not the result of scientific measurement, diagnostic analysis, or evaluation. Any perceived correspondence between the outputs and lived experience arise soley through resonance and are subjectively interpreted.

Catoptica does not provide:

• medical or psychological diagnoses

• health assessments or safety evaluations

• scientific or objectively verifiable translations

9. VIDEO RECORDING AND SHARED CONTENT

(a) The Product includes an optional feature that allows you to record video and audio while the Product generates symbolic outputs. Any video recordings you create (“Recorded Content”) are stored locally on your device and are not transmitted to, collected by, or accessible to Catoptica Pty Ltd.

(b) You are solely responsible for the creation, review, and sharing of any Recorded Content. Catoptica Pty Ltd does not monitor, store, process, or control Recorded Content and is not liable for its use, disclosure, or distribution.

(c) You must ensure that any Recorded Content you share complies with the policies of any third-party platform, including social media, messaging apps, or cloud storage services.

(d) You must not record or share content that infringes on the rights, privacy, or safety of others. You acknowledge that you are solely responsible for obtaining any necessary permissions from individuals who may appear in Recorded Content.

(e) Catoptica Pty Ltd does not endorse or take responsibility for interpretations, claims, or representations made in Recorded Content.

10. LIMITATION OF LIABILITY

To the extent permitted by law, Catoptica Pty Ltd is not liable for:

• emotional, psychological, symbolic, or interpretive responses

• device incompatibility or performance variations

• data loss, corruption, or damage

• business interruption

• indirect, special, or consequential losses

• reliance on symbolic outputs for real-world decisions

Total liability is capped at the amount paid by you in the 12 months prior to a claim.

11. TERMINATION

Your licence may be terminated immediately if you:

• breach these Terms

• engage in prohibited, abusive, or disrespectful use

• attempt to reverse engineer or modify the Product

• misuse or publicly misrepresent the Product’s artistic intent

• infringe intellectual property or moral rights

Upon termination, you must uninstall and delete all copies of the Product.

12. GENERAL PROVISIONS

• These Terms are governed by the laws of Western Australia.

• If any clause is unenforceable, it is severed; the remainder continues in force.

• These Terms constitute the entire agreement between you and Catoptica Pty Ltd, and apply in addition to any applicable App Store end user licence agreement. 

• Updates may be provided via app updates or online posting; continued use indicates acceptance.

13. ELECTRONIC ACCEPTANCE

By installing, opening, or using the Product, you agree that these Terms form a binding legal agreement.

Product Risks

The Product:

• blurs the boundaries of art and science in a symbolic, experiential way

• is subjective, poetic, reflective, and interpretive

• may appear to reveal thoughts, feelings, or intentions

• may evoke strong emotional, psychological, or spiritual responses

• may be influenced by electromagnetic interference

• may produce outputs that feel intense, uncanny, or confronting

• may produce unexpected outputs

Users should discontinue use if distressed.

Disclaimer

Catoptica generates meaningful, intuitive, and resonant symbolic content in connection with real-world events and experiences. Like love, these moments of alignment cannot be measured objectively. They are subjectively experienced and interpreted. While the outputs may assist with your investigations into reality, they must not be viewed as objectively verifiable, scientific, diagnostic, or factual assessments. Catoptica does not provide veterinary, medical, psychological, safety, or objective paranormal evaluation or diagnosis. All interpretations are user-guided.
