These Terms and Conditions govern your use of the Catoptica mobile application (Product) supplied by Catoptica Pty Ltd (Catoptica, we, us).

By installing or using the Product, you agree to these Terms. If you do not agree, do not use the Product.

Important Notice for Apple users: The Product is licensed to you under Apple’s Standard End User License Agreement (EULA). These Terms apply in addition to Apple’s Standard EULA. If there is any inconsistency, Apple’s Standard EULA prevails.

1. Definitions

App Stores means the Apple App Store and Google Play Store.

Output means any text, phrase, label, image, audio, colour, score, category, or other content produced by the Product.

Representational Output means an Output intended as an interpretive and reflective depiction of ambience, experience, or subjective state, and not objective proof or a statement of fact.

Recorded Content means any video recorded using the Product.

Terms means these Terms and Conditions.

2. Nature of the Product and Acceptance of Use

By using the Product, you acknowledge and agree that:

Catoptica is a spiritual and interpretive technology that uses magnetism to select Outputs that are interpretive, symbolic, and subjective. You may use Outputs for reflection, inquiry, interpretive exploration, and as prompts for further investigation. Outputs may sometimes feel meaningful or aligned with your experience, observations, or later professional input. However, on their own, they are not objective proof, conclusive evidence, diagnosis, or conclusive truth. You must not rely on them as objective proof or conclusive evidence about any person, animal, or event. 

You use the Product at your own risk and should stop using it if it causes any distress or overwhelm.

We grant you a revocable, non-transferable, non-exclusive, limited licence to use the Product subject to these Terms.

3. Licence Grant

(a) You may install and use the Product on devices associated with your Apple ID or Google account, subject to applicable App Store terms.

(b) Distribution, installation, billing, and subscription management are governed by the relevant App Store rules. If those rules conflict with these Terms, the App Store rules prevail.

(c) You must not export, copy, or redistribute the Product except as permitted by law and applicable App Store rules.

4. Limits on Use

You must not:

• reverse engineer, decompile, modify, or attempt to derive the source code of the Product

• copy or reproduce the Product other than through standard device backup processes

• circumvent subscriptions, access controls, or parental controls

• use the Product for unlawful, harmful, or abusive purposes

• commercialise the Product without our written permission

• use or rely on Outputs as objective proof, conclusive evidence, formal diagnosis, formal assessment, or as a sufficient basis on their own in relation to any person, animal, environment, event, or situation

• use the Product or any Output as the sole or primary basis for employment screening, policing, formal investigations, court or tribunal proceedings, medical or veterinary triage, threat assessment, security decision-making, or any other safety-critical or consequential decision

• use Outputs to harass, shame, intimidate, threaten, unlawfully surveil, control, defame, dox, or discriminate against anyone

• use Outputs as the sole or primary basis for any accusation, report, intervention, escalation, safeguarding response, or other decision where reliance could reasonably cause harm

• remove, hide, or alter any warning, caption, label, watermark, or notice stating that Outputs are interpretive or non-factual

For clarity, these Terms do not prevent you from using the Product for lawful personal or professional reflection, inquiry, interpretive exploration, or environmental observation, provided you do not use the Product, Outputs, screenshots, recordings, captions, or commentary as conclusive evidence, as the sole or primary basis for important decisions, or as part of unlawful surveillance, stalking, coercive control, intimidation, harassment, discrimination, defamation, or privacy-invasive conduct. 

5. Independent Checking and Decision-Making

Catoptica may prompt further inquiry, observation, or checking. Outputs may be compared with context, lived experience, independent observation, and professional or other supporting evidence, but they do not by themselves establish that any inferred fact, condition, intention, risk, or meaning is true.

If a decision could affect safety, health, pet care, employment, legal rights, finances, reputation, relationships, or the wellbeing of any person or animal, you should not rely on Catoptica alone. Important decisions should be based on independent observation, contextual verification, and, where appropriate, professional advice or other supporting evidence.

6. Intellectual Property

(a) We retain ownership of the Product and all related intellectual property rights.

(b) The Catoptica algorithm, Lexicon of the Soul, text corpus, audio content, artistic framework, and related materials remain protected works.

(c) Helah K Milroy retains all moral rights, including rights of attribution and integrity.

(d) No cultural, ceremonial, spiritual, or cosmological rights connected with the Product are transferred to you.

7. Subscriptions, Ads, and Features

(a) Subscriptions

Ad-free access, offline use, and certain expanded features require an auto-renewable subscription. Payment will be charged to your Apple ID or Google account when you confirm purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your App Store or Google Play settings.

(b) Anonymous subscription system

The Product uses RevenueCat to assign a non-identifying anonymous appUserID to validate subscription status. No names, email addresses, or personal profiles are required for this function.

(c) Advertising

The Product uses Google AdMob, which may collect limited device data, such as device identifiers, coarse location, and usage data, for personalised or non-personalised ads depending on your consent settings. AdMob Privacy Policy: https://policies.google.com/technologies/ads

(d) Parental Lock PIN

An optional parental lock may be used to restrict access to the Uncensored Lexicon. The PIN is stored locally on your device, is never sent to us, and cannot be recovered or reset by us.

8. Warranties and Disclaimers

The Product is provided “as is.”

Catoptica does not provide objective proof, conclusive evidence, diagnosis, professional advice, or standalone decision support. We do not guarantee output accuracy, stability, device compatibility, or consistent operation across all environments.

Outputs are interpretive and subjective. They may feel resonant, significant, or useful, but they are not conclusive findings. Any apparent match between an Output and later events, observations, or professional input does not by itself make the Output objective proof, conclusive evidence, diagnostic, or determinative.

Nothing in these Terms excludes, restricts, or modifies any non-excludable right or remedy you may have under applicable law, including the Australian Consumer Law.

Where the law allows us to limit liability for breach of a statutory guarantee, our liability is limited, at our option, to supplying the services again, paying the cost of having the services supplied again, replacing goods, repairing goods, supplying equivalent goods, or paying the relevant replacement or repair cost.

9. Recorded Content

(a) The Product includes an optional feature that allows you to record video while Outputs are generated. 

(b) Recorded Content is stored locally on your device and is not transmitted to, collected by, or accessible to us.

(c) You are solely responsible for creating, reviewing, using, and sharing Recorded Content. If you choose to export, save, screen share, livestream, upload, send, or otherwise share Recorded Content outside the Product, you do so at your own discretion and responsibility using third-party services or device functions not controlled by us. 

(d) You must ensure that any sharing of Recorded Content complies with applicable law and the policies of any third-party platform you use.

(e) You are responsible for obtaining any consent, permission, or approval required by law from any person who appears in, is audible in, or may be affected by Recorded Content.

(f) You must not use the Product or any recording made with it to covertly record private conversations, private activities, or anything else where recording is unlawful or restricted.

(g) You must not use Recorded Content or embedded Outputs as objective proof, conclusive evidence, or sufficient verification on their own of another person’s or animal’s condition, thoughts, intent, truthfulness, conduct, or consent.

(h) If the Product includes any warning, caption, label, watermark, or notice stating that Outputs are interpretive or non-factual, you must not remove, alter, hide, or misrepresent it.

(i) We are not responsible for any interpretation, claim, edit, caption, commentary, or representation made by you or others in relation to Recorded Content.

10. External Community Platforms

The Product allows users to create Recorded Content locally on their own device. However, the Product does not host, publish, transmit, display, distribute, or make Recorded Content or other user-generated content available to other users within the Product. The Product does not include in-app messaging, social networking, public posting, commenting, user profiles, follower systems, livestreaming, or user-to-user content feeds. 

Any links to external communities are optional references only and are not part of the Product. Those platforms are not owned or controlled by us within the app. Access is voluntary and at your own discretion.

If we participate in external community spaces, moderation and enforcement are governed by that platform’s tools and policies. We do not provide real-time moderation, age verification, or safety monitoring within third-party communities.

Users must not post or encourage unlawful, defamatory, harassing, threatening, discriminatory, exploitative, or privacy-invasive content in those spaces.

11. User Conduct and Claims

You must not:

• use Outputs to harass, shame, intimidate, threaten, unlawfully surveil, control, defame, dox, or discriminate against anyone

• use Outputs as conclusive evidence or as the sole or primary basis for important decisions

• claim that an Output, by itself, conclusively establishes a person’s or animal’s mental state, intentions, health, conduct, consent, or suitability

• use the Product in breach of privacy, surveillance, discrimination, consumer, defamation, or other applicable laws

12. Indemnity

To the maximum extent permitted by law, you indemnify Catoptica Pty Ltd and its officers, employees, contractors, and agents against third-party claims, losses, liabilities, damages, costs, and reasonable legal expenses arising from:

(a) your breach of these Terms; or
(b) your unlawful conduct in connection with the Product or any Recorded Content, including unlawful recording, harassment, defamation, privacy breaches, misleading representations, or intellectual property infringement.

This does not apply to the extent the claim was caused by our negligence, fraud, or wilful misconduct, and is subject to any rights that cannot lawfully be excluded or limited.

13. Limitation of Liability

To the extent permitted by law, we are not liable for:

• emotional, psychological, symbolic, or interpretive responses to Outputs

• device incompatibility or performance variation

• data loss, corruption, or damage

• business interruption

• indirect, special, or consequential loss

• reliance on Outputs or Recorded Content as proof, conclusive evidence, diagnosis, security guidance, or the sole or primary basis for real-world decisions

To the extent permitted by law, our total liability is capped at the amount you paid us in the 12 months before the claim arose.

14. Termination

Your licence may be terminated immediately if you:

• breach these Terms

• engage in prohibited, abusive, or unlawful use

• attempt to reverse engineer or modify the Product

• misuse or publicly misrepresent the Product

• infringe intellectual property or moral rights

If your licence is terminated, you must uninstall and delete all copies of the Product.

15. General

These Terms are governed by the laws of Western Australia.

If any provision is unenforceable, it is severed and the rest of the Terms continue.

These Terms form the entire agreement between you and Catoptica Pty Ltd in relation to the Product, subject to any applicable App Store terms.

We may update these Terms from time to time. If we make a material change, we may notify you through the app, on our website, through the relevant App Store listing, or by another reasonable method. Where required by law, or where we consider it appropriate, we may require your acceptance of updated Terms before continued use.

16. Electronic Acceptance

By installing, opening, or using the Product, you agree to be bound by these Terms.

If we present updated Terms for express acceptance, continued access to relevant features may depend on that acceptance.

Product Risks

The Product:

• is symbolic, interpretive, and subjective

• may evoke strong emotional, psychological, or spiritual responses

• may be affected by electromagnetic interference

• may produce unexpected, uncanny, or confronting Outputs

Stop using the Product if it causes distress.

Outputs are not objective proof, conclusive evidence, diagnosis, or conclusive truth, and should not be relied on as the sole or primary basis for important decisions.
